Business Members agree to defend and indemnify Excentum and its affiliates and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of any Tenancy Reference Data submitted to Excentum, and to the referral to, reliance on or further use of any Tenancy Reference Data obtained through Excentum by any third party.
Neither Excentum nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Your use of any information or materials on this website, or through any Tenancy Reference Data, offered or supplied, or Tenancy Reference Data Matching Service offered by Excentum, is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website, and any Tenancy Reference Data or Tenancy Reference Data Matching Service provided, meet your specific requirements.

Excentum – Limitation of Liability
Under no circumstances (including but not limited to any act or omission on the part of Excentum) will Excentum be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access, the Site, any Tenancy Reference Data, or Tenancy Reference Data Matching Service offered by Excentum, or any content on this website. Visitors release and hold harmless Excentum, their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with any content on the Excentum.co.uk website or the content of any Tenancy Reference Data, or Tenancy Reference Data Matching Service, provided by or supplied by or made available by Excentum.
You expressly acknowledge and agree that you release and hold harmless Excentum, their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Excentum.co.uk website and any information or data provided or included in any Tenancy Reference Data or Tenancy Reference Data Matching Service offered by Excentum.
Excentum is not and shall not be held responsible for any incorrect and/or inaccurate information on its website or contained in any Tenancy Reference Data, or in Tenancy Reference Data Matching Service offered by Excentum, whether caused by information submitted by users, business members, website users and/or by any of the equipment and/or programming associated with and/or used by Excentum or by any technical or human error which may occur in the processing of information or content on the Excentum website or in any Tenancy Reference Data or otherwise.
Excentum is not and shall not be held responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft and/or destruction and/or unauthorised access to, and/or alteration of, content. Excentum is not and shall not be held responsible for any problems and/or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail and/or participants on account of technical problems and/or traffic congestion on the Internet and/or at any website or combination thereof, including injury or damage to any user/visitor or to any other person’s computer related to and/or resulting from visiting or accessing Excentum.co.uk website.

Excentum – Submission of Tenancy Reference Data
In submitting Tenancy Reference Data to Excentum, Landlords, Letting Agents, Letting Agencies, Property Management Companies and other authorised agents acting on behalf of Landlords (Business Members) accept and agree that they are solely responsible for, and assume all liability regarding;
- (i) the information and content contributed to Excentum by means of any Tenancy Reference Data provided or have provided for on their behalf by any other party; and
- (ii) the information and content submitted, transmitted, published, or otherwise made available (hereinafter “Submission”) to Excentum and its Tenancy Reference Data records. and
Landlords, Letting Agents, Letting Agencies, Property Management Companies and other authorised agents acting on behalf of Landlords (Business Members) further accept and agree that they will not provide inaccurate, misleading or false information to Excentum. If information provided to Excentum subsequently becomes inaccurate, misleading or false or where Excentum discovers that such information is inaccurate, misleading or false, Landlords, Letting Agents, Letting Agencies, Property Management Companies and other authorised agents acting on behalf of Landlords (Business Members) accept and agree that they will promptly notify Excentum of such change.
Excentum reserves the right to remove and delete any Tenancy Reference Data, that in its sole opinion violates, or may violate, any applicable law or the letter or spirit of its policies, as it sees fit or upon the request of any third party.

Excentum – Jurisdiction and Governing Laws
This agreement will be governed by and construed in accordance with the laws of the United Kingdom. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect. All rights not expressly granted herein are reserved.
If any court having the appropriate authority finds that any of these terms are not valid, this will not affect the validity of any of the other terms in this notice. If Excentum fails to take advantage of any right it has under these terms, it does not mean you or Excentum are giving up that right.
These terms will be governed by, and interpreted in line with, English law. You agree that the English courts will have full authority to settle any dispute that may arise out of or in connection with these terms.

The Tenancy Reference Data we process is done so in accordance with the Conditions for Processing – ‘Legitimate Interests’ as contained in Article 7 of the Data Protection Directive (95/46/EC). See our Terms of Use and Privacy Policy pages for more information.
Some of the Tenancy Reference Data we process may also constitute opinion, and such opinion, where included in Tenancy Reference Data supplied by Excentum to Business Members as part of our services may not be inaccurate if it faithfully represents someone’s opinion about a Tenancy period.
