Tenancy Reference Data
Tenancy Reference data may only be submitted by ‘Business Members’ who are:
- Landlords,
- Letting Agents,
- Letting Agencies,
- Property Management Companies, and
- other authorised agents acting on behalf of Landlords.
The Excentum Tenancy Reference Data Matching Service can only be accessed by registered ‘Business Members’.

Business Membership
‘Business Members’ are herein defined as persons or business entities who have registered as Business Members with Excentum and where they have satisfied the proof of Business Identification or if individual Landlords, proof of identification and proof of residence/business address as may be required by Excentum. Only ‘Business Members’ have access to the Excentum Tenancy Reference Data Matching Services.
During the period of membership such ‘Business Members’ have exclusive access to Excentum Tenancy Reference Data by means of our Tenancy Reference Data Matching Service, with the facility to conduct up to 100 individual searches per month.
Additional searches above this figure can be provided, wherein each search related to one specific address will result in a search charge, such charge to be specified by Excentum, payable only where a record is found as being held by Excentum. Where Excentum do not hold any Tenancy Reference Data for the address specified by the Business Member, no search charge will apply and the search fee paid will be refunded to the member within 7 working days.

Business Members
Tenancy Reference Data submitted by ‘Business Members’ will be reviewed and the identity of the Business Member authenticated using the information provided as part of the Business Membership application process, where such information can be confirmed to the best of the ability of Excentum.
Tenancy Reference Data submitted by a ‘Business Member’ will not be added to the Excentum Tenancy Reference Data records until the identity of the Business Member has been accepted by Excentum.

Business Members – Requesting Tenancy Reference Data
Business Members, whose membership is currently active may request use of our Tenancy Reference Data Matching Service for regarding Tenancy Data as may be held by Excentum. Each request will result in Excentum undertaking a search of its records of Tenancy Reference Data records.
Each currently active Business Member can request up to 100 searches per month using our Tenancy Reference Data Matching Services during their membership. Each search request, even where Excentum do not hold any Tenancy Data for the Tenancy period, will be counted as a ‘search’ and will reduce the number of searches available to the member as part of their membership.
For ‘Business Members’ a ‘normal’ search (outside of the 100 free searches) of Excentum Tenancy Reference Data, related to one Tenancy period, will result in a search charge, such charge to be specified by Excentum, payable only where a Tenancy Reference Data Match occurs. Where Excentum does not hold any Tenancy Data for the Tenancy period, no search charge will apply and the search fee paid will be refunded to the member within 7 working days.

Business Members – Search Results
Where a Business Member has requested use of our Tenancy Reference Data Matching Service, and a match occurs, a copy of the matching Tenancy Reference Data will be forwarded to the Business Member by e-mail, at the e-mail address on file for the member, within 24-48 hours of completion of the search.
Tenancy Reference Data will not contain any ‘personal data’ which can identify a particular or specific individual, i.e. name, date of birth, nationality, race or ethnic origin, religion, sexuality, marital status, medical history/conditions, employer, national insurance number or current/previous address.
Tenancy Reference Data will not contain the name or contact details for a landlord or landlords agent who provided the Tenancy Reference Data unless those persons/businesses have given Excentum direct and overt consent to provide this information as part of any Tenancy Reference Data which can be provided to a third-party.

Business Members – Submitting Tenancy Reference Data
In submitting Tenancy Reference Data to Excentum through the Excentum.co.uk website, by e-mail or any other method (collectively, “Submissions”), Business Members grant Excentum a non-exclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to:
- use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised, for any purpose; and
- sell, rent, loan or make use of such submission in return for monies or other form of remuneration or benefit, financial or otherwise, without any right or legal recourse to seek to claim any monies, income, benefit or value for such Tenancy Reference Data from Excentum to Excentum Business Members only; and
- use the Business Members name submitted in connection with such Submission – only where the Business Member has expressed their direct consent for this to occur. Business Members further grant Excentum the right to pursue at law any person or entity that violates their or Excentum’s rights in the Submissions by a breach of this Agreement. Business Members acknowledge and agree that Submissions are non-confidential and non-proprietary.
Business Members agree that they are solely responsible for, and assume all liability regarding,
- the information and content they contribute to Excentum by means of any Tenancy Reference Data they provide or have provided on their behalf by any other party; and
- the information and content they submit, transmit, publish, or otherwise make available (hereinafter “Submission”) to Excentum and its Tenancy Reference Data records.
Business Members agree that they will not provide inaccurate, misleading or false information to Excentum. If information provided to Excentum subsequently becomes inaccurate, misleading or false, Business Members agree that they will promptly notify Excentum of such change.

Business Members – Identification
Persons or business entities seeking to obtain ‘Business Membership’ with Excentum will be required to provide suitable and appropriate proof of identification and residence/business address, as determined by Excentum including any proof of business registration with Companies House and registration as a Data Controller or Data Processor with of the Information Commissioners Office (ICO) or any other agency or body as Excentum may require.

Data Protection
In accordance with the Data Protection Act 1998, Tenancy Reference Data held by Excentum does not constitute ‘Personal Data’ and as such, is not subject to said act.
However, Excentum takes its responsibility regarding the obtaining, processing, management and use of all forms of ‘data’ in it possession seriously. Excentum is registered with the Information Commissioners Office (ICO.org.uk) as a Data Controller for data protection purposes.
In keeping with the underlying guiding ‘good practice’ principles of Data Protection, Excentum treats all Tenancy Reference Data it holds as subject to the disclosure/right of access as applies to ‘Personal Data’ for the purpose of Subject Access Requests (SAR’s).
Excentum is not a credit score/referencing agency and does not seek, obtain, research, provide information on or any store data on any credit ratings, credit history, credit scoring systems or county court judgements. Excentum is fully registered with the Information Commissioners Office (ICO.org.uk) for data protection purposes.

Business Members- Right of Amendment and Correction
Business members have the right to seek to alter, amend, correct or update any Tenancy Reference Data submitted to Excentum. Any request to alter, amend, correct or update any Tenancy Reference Data held by Excentum must be submitted to Excentum by e-mail. Any applications to alter, amend, correct or update any Tenancy Reference Data held by Excentum by post, telephone or in person will not be accepted by Excentum.
Excentum retains the right to seek appropriate confirmation of the identity of the person/business seeking to alter, amend, correct or update any Tenancy Reference data held by Excentum as is seen fit and appropriate by Excentum.
Where a Business Member has requested that Excentum alter, amend, correct or update any Tenancy Reference Data, and such request is accepted and approved by Excentum, the Tenancy Reference data will be ‘updated’ within 30 days and confirmation of such ‘update’ will be forwarded to the Business Member by e-mail or at any confirmed postal address provided by the Business Member.

Right of Content Removal or Alteration
Excentum reserves the right to remove any such information or material that in its sole opinion violates, or may violate,
- any applicable law,
- either the letter or spirit of Excentum’s operational policies or practices,
- upon the request of any third party where deemed appropriate,
- or where such data is in breach of Data Protection Act or where the Information Commissioner’s Office or any court has requested or ordered that such data be altered or removed.

Altering or Amending Tenancy Reference Data
Excentum is unable to alter, amend or remove any Tenancy Reference Data without the explicit permission and consent of the Landlord, Letting Agent, Letting Agency, Property Management Company or other authorised agents acting on behalf of a Landlord (Business Members) who submitted the original Tenancy Reference Data.
Excentum will alter or amend, or remove, Tenancy Reference Data where such information is in breach of Data Protection Act or where the Information Commissioner’s Office or any court has requested or ordered that such data be altered or removed.

Right of Amendment and Correction – Data Subject
Persons, herein described as ‘Data Subjects’, have the right to seek to alter, amend, correct or update any Tenancy Reference Data held or managed by Excentum, only where such request is compatible with rights of an individual as conferred under Data Protection Legislation.
Any request to alter, amend, correct or update any Tenancy Reference Data held by Excentum must be submitted to Excentum by e-mail primarily, or by post, at our registered address listed on this website. Applications to alter, amend, correct or update any Tenancy Reference Data held by Excentum by telephone or in person will not be accepted by Excentum.
Excentum retains the right to seek appropriate confirmation of the identity of the person seeking to alter, amend, correct or update any Tenancy Reference Data held by Excentum as is seen fit and appropriate by Excentum.
Data Subjects can seek to exercise a ‘Right of Amendment and Correction’ to alter, amend, correct or update any Tenancy Reference Data held by Excentum, only where such request is compatible with rights of an individual as conferred under Data Protection Legislation.

Personal Opinion
Tenancy Reference Data held by Excentum, and made available to Business Members, may not be inaccurate if it faithfully represents someone’s opinion about a Tenancy period. In these circumstances, the Tenancy Reference Data would not need to be “corrected”, but the Excentum may add a note stating that the Data Subject disagrees with the opinion. Conditions for Processing – ‘Legitimate Interests’
Article 7 of the Data Protection Directive (95/46/EC) sets out legal grounds for processing personal data based on reasons other than the unambiguous consent of the data subject. The Directive states the following are legitimate conditions for processing personal data:
(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by the third party or parties to whom the data are disclosed, except where such interests are overridden by the interests for fundamental rights and freedoms of the data subject which require protection under Article 1 (1).
In this instance, the ‘Legitimate Interest’s’ condition provides grounds to process personal data in a situation where an organisation needs to do so for the purpose of its own legitimate interests or the legitimate interests of the third party that the information is disclosed to. In this instance, Excentum is satisfied the processing of the data submitted, identified as a Tenancy Reference Data, complies with this definition and does not prejudice the rights and freedoms or legitimate interests of the individual whose data is being processed.

Business Membership Fees / Billing
Where use of the Tenancy Reference Data service offered by Excentum exceeds the free usage quota, and only where such has been agreed between the Business Member and Excentum, additional charges may apply only with the prior written approval of the Business Member.
Excentum uses an automated payment processing system and only accepts credit card payments at this time. Business Members exceeding the free quota of Tenancy Reference Data searches are required to maintain valid credit card information on file with Excentum for the processing of any applicable service fees. At its sole discretion, Excentum may use credit card issuer-approved services to acquire updated payment information for the purpose of processing outstanding payments that are on Business Members accounts.
Billing inquiries and disputes should be brought to Excentum’s attention within 30 days of any the invoice date. Failure to do so will be deemed to be an admission that the invoice and charges are accurate.
If any chargeback or charge dispute notices are received for your account, services provided to you may be immediately suspended pending investigation, and you will be subject to chargeback service charges. Where applicable, Excentum reserves the right to put your Business Membership into “ Hold” status and deny any activity for that membership until the chargeback or dispute issue has been resolved.
Business Memberships will be suspended if fees are not paid within 72 hours of the due date. Accounts suspended in this manner can be re-activated upon payment of the Account Reactivation Fee.
